The Supreme Court of India has dismissed a Public Interest Litigation (PIL) that challenged the restoration of Rahul Gandhi's Lok Sabha membership. The PIL was filed following the stay on Gandhi's conviction in a case related to a remark on the 'Modi' surname.
On August 4, the Supreme Court issued a stay order on the conviction pertaining to Rahul Gandhi's comment during a public rally, where he allegedly associated the 'Modi' surname with corruption. Following this, the Lok Sabha Secretariat restored his membership.
In the Supreme Court, the bench comprising of Justices S K Kaul and M M Sundresh, stated, "The subject matter of the plea is within the domain of the Speaker of the Lok Sabha and the court should refrain from interfering in it."
The bench further added that the plea was 'premature' and 'misconceived'. It was also observed that the petitioner, a lawyer by profession, should have approached the Speaker of the Lok Sabha before moving to the apex court.
The challenge to the restoration of Rahul Gandhi's Lok Sabha membership was based on the argument that his conviction had not been formally quashed, and hence, his membership could not be restored.
